Abstract

Abstract The prosecution of crimes committed against officials of the International Criminal Court، as stipulated in Article (70) of the Rome Statute، is deemed having a paramount importance to ensuring the efficient and effective administration of justice before the Court. Given the threats to which Court officials have been subjected and the measures recently taken against them for carrying out their duties، the prosecution of the Court thereabout raises the question of whether there are difficulties associated with carrying it out in light of the provisions of the Rome Statute and its supplementary rules stipulated thereby، especially given the lack of implementations therefor till date. In an attempt to answer this question، the research addressed this topic in a study according to an analytical methodology، and yielded several results indicating that the prosecution of these crimes is associated with some difficulties that primarily hinder its achievement، whether in terms of the court exercising its judicial jurisdiction over them، or in terms of its directing judicial proceedings in its regard، and there is no way to overcome these difficulties except by striving to amend a number of the provisions stipulated for prosecution.
