This research deals with a comparative study to determine the party who has the burden of proof in individual labor disputes, for this it was necessary to clarify the concept of individual dispute in order not to mix with collective work disputes, also we have clarified the definition of proof and its place and who bears its burden, Then we reviewed the three most important issues of dispute between the worker and the employer, which are proving the contract of employment and the rights arising from it, proof of payment of wages, and proof of the legitimate justification for termination of the contract for an indefinite period.
