Abstract

In this research, we talked about criminal protection in period of armed conflicts, whether of an international character or not of an international character, where we explained the provisions of criminal responsibility for crimes against civilians during armed conflicts and the sources of criminalization written in international treaties, as well as the role of international custom. As a source of criminalization, then we clarified the extent to which the state and the individual are responsible for crimes committed against civilians, as well as the ways to pay this criminal responsibility, leading to the permanent role of the International Criminal Court in protecting the civilian population from crimes committed against them, all in order to achieve greater protection to the victims of these conflicts, and to adopt new ideas that achieve this protection and for the protection of these victims, both at the international level for the crimes committed against them or at the national level for internal crimes, because the purpose of protection is to obtain criminal protection for people affected by these armed conflicts and to achieve justice criminal to them.
